Doris Law Office Professional Corporation has been engaged by PGC to represent the group of PGC members who have asked to be on our Mandamus list. This class action process involves appointing a single individual to represent the class. That person will file an affidavit and application to the Court on behalf of the group, respond to any examinations requested by the other side, and direct the course of events as they unfold. David Whidden has been appointed as that individual to represent the group, however most of the work will be done by the law firm.. Dave is a co-founder, director, and officer of PGC, as well as a participant in Profitable Giving in 2012. Dave's 2012 tax return was filed in the spring of 2013 and is presently being held by the CRA, awaiting the results of their RPGA audit.
For you to formally become a member of the group, you will need to complete the application form which you can get by clicking on the document below and return it to PGC/Doris Law. Part of the application contains a section where you grant Doris Law Office and David Whidden, the authority to act on your behalf through the Limited Power of Attorney. You will also need to submit the T1 General section of your 2012 tax return, which will be filed with the Court as an exhibit (this is the four or five page front section of your tax return that contains your signature and date of filing- please sign your file copy, if it is not already signed). All documents you submit will be held in the utmost of confidence.
The CRA's actions are starting to have serious consequential damages for many taxpayers. Since CRA is simply not issuing 2012 tax assessments, the various other private sector and governmental bodies that rely on this information are not able to function. This has resulted in serious consequences such as the following:
- Homeowners cannot get mortgage approvals or renewals. No CRA assessment is available for proof of income as required by the banks
- Taxpayers cannot get financing or re-financing of personal loans for the same reason
- Families are or will be missing benefits such as the child tax credit, and the GST/HST tax credits.
- Provincial benefits such as the BC Pharmacare program and the Ontario Trillium Benefits are negatively affected.
- Anything that requires taxpayers to provide proof of income for 2012 via the CRA Notice of Assessment will be delayed or eliminated for years.
If you are experiencing any of these consequential damages, please tell us about it on page 2 of the PGC application. Our action will not be making any type of compensation claim for damages, however, the fact that these damages are occurring gives additional reason for the Court to grant the application and act quicker. You may be required to provide proof of what you tell us.

REMEMBER: You must be a paid Member of PGC for your application to be accepted.
